Terms
Last updated 30 October 2026
These terms are between Capability Systems Ltd (“we”) and the business that subscribes to PitchBot (“you”). PitchBot is sold to businesses only, not to consumers.
The service
PitchBot is a hosted service. We read the pages of your website, and a chat on your site answers your visitors' questions from them and can book sales calls into the calendar you connect. We host and run it; no software or code is handed over.
PitchBot's replies are written by an AI model from your pages. They can be wrong or incomplete, so don't rely on them for prices, contracts or advice without checking.
Plans and payment
- Small: $89 a month for up to 200 conversations a month.
- Starter: $135 a month for up to 500 conversations a month.
Prices are in US dollars and exclude VAT, which is added where it applies. Each plan also includes a monthly chat allowance. Long conversations and updates to your website use more of it, so in a busy month it can run out before you reach your conversation limit. When you reach either limit, the chat passes visitors to your booking link or contact details until the next month starts; we don't charge for extra conversations.
A new company starts with a free trial of 14 days. When it ends, unless you have chosen a plan, the chat passes visitors to your booking link, contact details or website, and we stop reading your website for updates, until you choose one.
How you pay
You can pay in one of three ways.
By card: your card is charged automatically each month, in advance, by Stripe, our payment provider. You can change your card, see invoices or cancel from the Plan and billing page in your dashboard.
By invoice: we send you an invoice each month, in advance, and payment is due within 14 days.
Through Upwork: if you found us through Upwork, you pay through Upwork for the first 24 months, under Upwork's terms.
Cancelling
You can cancel at any time. Card customers cancel from the Plan and billing page; invoice customers email us at hello@pitchbot.ai; Upwork customers end the contract on Upwork. The service carries on until the end of the month you've paid for, and then stops. We don't refund part-months.
We can end the service with 30 days' notice, or straight away if an invoice is more than 30 days overdue.
Your visitors' data
For the chats on your website, you are the controller of your visitors' personal data and we process it for you. This section is our data processing agreement with you, under Article 28 of the UK GDPR.
What we process: your visitors' messages and PitchBot's replies, their time zone, a coded form of their IP address, and, when they book a call, their name, email address, phone number if they give it, and the time they chose, and the copies of the emails we send them. We process it to answer your visitors and book the calls they ask for, for as long as the contract lasts and then as set out below.
- We process your visitors' personal data only to run PitchBot for you, as these terms and your settings in the dashboard describe, or as you tell us in writing. If we think an instruction breaks data protection law, we tell you.
- Everyone who works on PitchBot for us is bound to keep the data confidential.
- We keep the data secure. It is encrypted when it is sent and when it is stored, and it is hosted by Microsoft Azure in the Netherlands, with backups in Ireland.
- You agree that we use the companies listed under “Who else handles it” on our privacy page that handle visitors' data, and we hold each of them to data protection terms that meet this section. We tell you before we add or replace one, and you can object. If we can't meet your objection, you can cancel.
- We help you answer your visitors' requests to see, correct or delete their data, and with any data protection impact assessment or consultation with the ICO that involves PitchBot.
- We tell you without undue delay after we become aware of a breach that affects your visitors' data.
- We delete your visitors' chats and booking details 12 months after they were made. When the contract ends, we give you a copy of your visitors' data if you ask for it within 30 days, and then delete it all, unless the law requires us to keep it.
- We give you the information you need to show that we meet this section, and allow audits, including inspections, by you or an auditor you appoint, on reasonable notice.
- Where your visitors' data goes to the United States, it is protected as our privacy page describes.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.
Apart from that, we are not liable for indirect or consequential loss, for loss of profits, revenue or business, or for any loss that comes from you or your visitors acting on a PitchBot reply without checking it.
Subject to the two paragraphs above, our total liability to you under or in connection with these terms, whether in contract, tort (including negligence) or otherwise, is limited to the fees you paid us for PitchBot in the 12 months before the event that gave rise to the claim.
Law
These terms are governed by the law of England and Wales, and its courts deal with any dispute.
